Crimes such as neglect of dutyand misconduct are actions committed by public officer or civil servant endingup with public nuisance and also are actions defined as criminal acts in thelaw. According to laws of the Republic of Turkey, forest engineers working inthe state forest administrations are qualified as public officer and also haveall rights, duties, responsibilities and authority granted to public officers.In this study it was aimed to examine the case studies as the defendant ofcrimes of official misconduct and neglect of duty of the forest engineers whoserved as public officers. For this purpose, cases in which the forestengineers subject to neglect of duty and misconduct while they are in charge ofstate forest administrations have been selected among the hundreds of highcourt decisions. 110 examples of the Supreme Court decisions obtained from theElectronic Law Database were grouped according to their subjects and thenanalyzed in detail. As a result of the assessment; the majority of cases relatedto neglect of duty of the forest engineers aroused from not to take a minutesdown for forest crimes. However, crimes related to misconduct aroused fromtheir willingness to undeserved individual gains from defendants or otherpersons by use of their positions and authorities. To reduce or even eliminatesuch incident cases, it is necessary that officers must know the rights,authorities, duties and responsibilities given to them, and that they do notmeddle in actions that constitute the resultant crime. |

Görevi ihmal ve görevi kötüyekullanma suçları, kamu görevlileri veya memurlar tarafından işlenen ve kamununzarara uğraması ile sonuçlanan, kanunlarda suç olarak tanımlanmış eylemlerdir.Devlet orman işletmelerinde çalışan orman mühendisleri de Türkiye Cumhuriyetikanunlarına göre devlet memuru sıfatındadır ve memurlara tanınan tüm hak,yetki, görev ve sorumluluklara haizdir. Bu çalışmada devlet ormanişletmelerinde çalışan orman mühendislerinin, görevi ihmal ve görevi kötüyekullanma suçunun faili oldukları örnek olayların incelenmesi hedeflenmiştir. Buamaçla, devlet orman işletmesinde görevliyken görevi ihmal ve görevi kötüyekullanma suçundan yargılanan orman mühendislerinin sanık olarak yer aldığıdavalar, çok sayıda yüksek mahkeme kararları içerisinden seçilmiştir.Elektronik hukuk veri tabanından elde edilen örnek 110 Yargıtay kararı detaylıolarak analiz edilmiş ve konularına göre gruplandırılmıştır. Yapılandeğerlendirme sonucunda; orman işleme şeflerinin görevi ihmal suçunun failioldukları davaların çoğunun, orman suçlarına karşı tutanak tutulmamasındankaynaklandığı görülmüştür. Görevi kötüye kullanma suçu konusunda ise sanıklarınmevki ve makamlarının kendilerine verdikleri yetkileri, bireysel veya diğerkişilere karşı haksız kazanç sağlama konusunda kullanmak istemelerindenkaynaklandığı tespit edilmiştir. Bu suçların azalması hatta yok olması içinmemurların kendilerine verilen hak, yetki, görev ve sorumluluklarını çok iyibilmesi ve sonucu suç teşkil eden eylemlere karışmaması gereklidir. |
